Florida Couple Files Suit After Sustaining Serious Injuries on Moving Walkway at Orlando Studios

MovingWalkway

A Florida couple says that they were seriously injured on the moving walkway at Universal Orlando Resort in a recent personal injury lawsuit filed in Orange County. According to the lawsuit, the Broward County residents were injured during their visit to the theme park on April 20, 2022. The moving walkway, which guests can board as they enter CityWalk before heading to either Universal Studios or Islands of Adventure, allegedly malfunctioned, the lawsuit says. It came to a sudden and abrupt complete stop, which shook the plaintiffs and others on the escalator at the same time.

According to the lawsuit, the theme park was allegedly negligent for failing to maintain and inspect the escalator that caused the plaintiffs to experience “significant bodily injuries.” The lawsuit contends that these injuries caused physical handicap, disfigurement, mental pain and suffering, loss of income, loss of the capacity for enjoyment of life, and that they incurred medical expenses as a result of the accident.

The plaintiffs are seeking a judgment in excess of $50,000, plus costs, and a trial by jury.

Escalator injury lawsuits

You can file a personal injury lawsuit if you are injured on an escalator. The property owner has a duty of care to ensure that the escalator is functioning properly and does not injure guests. According to the lawsuit, the escalator malfunctioned resulting in injury to the plaintiffs. These injuries were serious in nature, the lawsuit alleges. Parties that might be liable for an escalator injury include:

  • The property owner
  • The escalator maintenance company
  • The escalator manufacturer

Your personal injury attorneys must prove that these parties were negligent in the maintenance of the escalator or that they manufactured a defective escalator. There are several grounds on which you can file an escalator injury lawsuit. These include:

  • Failure to maintain and inspect the escalator regularly
  • Improper maintenance on the escalator
  • Defective or improper escalator design
  • Failure to place signs indicating an escalator was broken
  • Failure to check on a poorly functioning escalator
  • Failure to follow building codes or regulations
  • Overcapacity of the escalator

In this case, we don’t know why the escalator malfunctioned. We just know that it suddenly stopped while several individuals were on it. This resulted in serious injury to the plaintiffs, who have now filed a personal injury lawsuit against Universal Orlando Resort.
