Nursing Home Sued After the Death of 88-Year-Old Resident

The daughter of an 88-year-old nursing home resident who died last year from malnutrition has filed a nursing home negligence lawsuit against the Waco nursing center where the woman lived for about 7 years. The family filed their lawsuit in Waco 74th State District Court against Eduro Healthcare, the parent company of Lakeshore Village Nursing and Rehab Center. The lawsuit seeks unspecified monetary damages and alleges medical negligence, corporate negligence, and gross negligence for the manner in which the center cared for the plaintiff.

According to the lawsuit, the plaintiff was a resident at the center from December 26th, 2016, to her death on August 20th, 2023. The lawsuit alleges her cause of death was severe protein-calorie malnutrition. The plaintiff suffered from diabetes and high blood pressure, according to the lawsuit, which alleges that the inadequate care she received there led to malnutrition, pain, suffering, and death.

The lawsuit further alleges that family members expressed concerns on several occasions in 2023 that the decedent was looking thin and losing weight, but were assured by staff members that she was getting sufficient nutrition.

“During the decedent’s treatment by Lakeshore, Plaintiff relied on Defendant’s representations, and it was their belief and understanding that the decedent was being properly cared for by Defendant at all times,” the lawsuit claims. “However, based upon Defendant’s negligence and other tortious misconduct as alleged herein, Plaintiff suffered substantial injury and damages including the decedent’s pain, suffering and death.”

The lawsuit further alleges that Eduro committed corporate negligence by failing to adequately fund and sufficiently staff the facility, failing to control the number of hours of direct patient care, and failing to properly train the medical and nursing staff.

Elements of negligence 

This case is an indication of just how bad nursing home negligence can get. In this case, one of the nursing home’s residents was so malnourished that she died of starvation. That should never happen. At the bare minimum, residents should be getting the nutrition they need to sustain a healthy life. The nursing home directly caused the death of this resident.

Nursing homes have an obvious duty of care to ensure that their residents are getting the proper nutrition. When they fail in this duty of care, residents can die. Since the nursing home is responsible for their eating habits, the nursing home is responsible for the woman’s death. The family has filed a wrongful death lawsuit against the nursing home on the grounds of medical negligence. They are also suing the nursing home for gross negligence, which is only alleged when the defendant commits extreme negligence. Hopefully, a jury sends a strong message to this nursing home and holds them accountable for this preventable death.
