Resident’s Body Found Stuffed in Storage Closet at Florida Nursing Home

LegalPI

On August 22, loved ones reported a man missing from North Dade Nursing and Rehab in Miami. His body was later found by authorities in a storage closet located within the nursing home. “He was stuffed in a closet for the last 12 days,” said the victim’s niece. “The officer advised he was so decomposed that they couldn’t recognize him.” According to the family, their loved one had recently been admitted to the nursing home after suffering an aneurysm.

The niece of the victim told the press that the nursing home said they had lost her uncle. Then, they transferred her to another nurse who said he signed a form to leave. The family contends that the resident could not have signed a form asking to leave the facility because his condition was too serious. They say at the point at which he went missing, he couldn’t even feed himself.

The victim was only there temporarily for rehab. He was supposed to stay for a short period of time while he was rehabilitated for his aneurysm. Now, he’s leaving the facility in a body bag.

Police refused to comment on how long the body was inside the facility before it was discovered. Further, they refused to comment on where exactly the body was found.

Nursing home negligence lawsuits

Nursing homes owe the same duty of care that hospitals owe to their patients. However, the news is replete with stories concerning deaths and injuries that occur in nursing homes resulting from substandard care. Often, the allegations against the nursing homes involve understaffing. In many cases, the nursing homes have been cited for serious regulatory shortcomings by state officials and inspectors.

As attorneys who have handled many negligence cases against nursing homes, the family is right to be upset about the treatment of their loved one. There is no excuse for a resident to go missing for 12 days while their body is stuffed in a storage closet. There’s simply no defense for that. However, we don’t know how the resident died. We only know that there is a substantial amount of negligence surrounding the nature of his death. But we’re light on specifics.

The family will likely hire a wrongful death nursing home negligence attorney to get answers from the nursing home. They can also hold the nursing home accountable for its failure to protect their loved one from obvious danger. With the help of a skilled nursing home negligence attorney, the family can get the answers that they deserve. They should also be paid for their emotional grief and the loss of love.
