Savage Boat Collision Leaves More Than a Dozen People Injured

A new lawsuit has been filed against the companies involved in a serious boat accident near Port Miami in February. The lawsuit left a dozen people injured and one victim with serious injuries. The passengers were aboard the Thriller tour boat on February 11 when a 43-foot charter boat, the Obelix, crashed into their ship. One victim, a mother of four, was left with life-threatening injuries after she was struck in the head. The victim’s husband also suffered injuries to his head as well as a severely dislocated shoulder and fractured ribs. An attorney representing the family said that the two vessels were headed on a collision course, but neither vessel did anything to prevent the collision.

The lawsuit blames both companies for the collision. The plaintiffs claim that both boats were traveling at excessive speed and engaged in “dangerous maneuvering” to “give thrills to passengers on board” but that neither vessel “maintained a proper lookout.” Theirs is the third lawsuit filed against the boating companies over this incident. The victim, at the time of the writing of this article, remains in critical condition and is fighting for her life. Over a month after the incident occurred, she was still being treated as a trauma patient.

Elements of negligence 

Well, the passengers certainly aren’t responsible for their injuries in this case. The plaintiffs blame both boats and the companies that operated them for the collision that led to their injuries. Neither boat appears to have maintained a proper lookout when the collision occurred, and the plaintiffs claim that both boats were operating irresponsibly at the time of the accident.

If this case goes to trial, the blame for the collision will likely be split among the two boats. The jury will be asked to determine how much liability or what percentage of liability each company shares for the collision. That will determine how much they have to pay to the plaintiffs. The boating companies will likely blame each other for the accident in a bid to reduce their liability. That’s a good position to be in if you’re a plaintiff, though I’m sure that the plaintiffs would rather not be injured than in a strong position to sue the boating company.
